Commerce Australia Pty Ltd of Level 2, 8 Parliament Place, West Perth ("Commerce") and Real Estate WA, Joondalup are the developers of the FindandFix system of enabling potential customers to identify and contact tradespeople via categorised lists accessible on the internet ("FindandFix").

Terms and Conditions for Registering Tradespeople

1. Registration as a tradesperson on the FindandFix database is subject to the completion of the application form obtainable from Real Estate WA.
2. Tradespeople registered on the FindandFix database agree to make every reasonable endeavour to make themselves accessible to the SMS message (when it becomes available), facsimile and email messaging initiated by Commerce, Real Estate WA or any third party utilising FindandFix.
3. Commerce and Real Estate WA do not warrant the availability of the website nor guarantee the delivery of the messages. No refund of any fee paid will be made for any failure of the provision of the system for whatever reason.
4. Each registered tradesperson agrees to allow Commerce and Real Estate WA to monitor and track all messages received by the tradesperson that have been initiated from FindandFix.
5. If requested by Commerce or Real Estate WA, the registered tradesperson will consent to and assist where reasonably required, any enquiry that Commerce or Real Estate WA may make of any third party for the purpose of ascertaining the quality and standards of the work undertaken at any previous time by the registered tradesperson.
6. Commerce and Real Estate WA do not warrant or guarantee that the registered tradesperson will receive any enquiry for work or any other reason from the subscription by the tradesperson to FindandFix.
7. Commerce and Real Estate reserve the right to reject any application for registration.
8. At its sole discretion, Commerce or Real Estate WA may terminate the registration of any registered tradesperson without notice and without refund for any unused period of the tradesperson's registration period, if a complaint made against the tradesperson to any government department or recognised membership body for any reason is found by the receiver of the complaint to be substantiated regardless of the penalty, if any, imposed.
9. Any breach of any of these Terms and Conditions may result in Commerce or Real Estate WA, at their sole discretion, terminating registration or ceasing the delivery of messages to a tradesperson without notice and without refund for any unused portion of the registration period.
10. The applicant agrees that Commerce and Real Estate are not liable for any loss or damages, howsoever caused, including but not limited to negligence, failure of a service or incorrect provision of a service.
11. These Terms and Conditions are subject to change at any time and without notice.

1. Commerce and Real Estate WA levies all annual subscription charges against each tradesperson who chooses to register on the FindandFix database of tradespeople. Commerce and Real Estate WA do not receive a fee in connection with any referral made to any tradesperson listed on the www.findandfix.com.au website, either at the time the referral is made or during or after the completion of the work initiated by such referral.
2. Commerce and Real Estate WA do not warrant or guarantee the work of any service provider listed on the www.findandfix.com.au website, either at the time of the listing or at any time before or after.
3. Commerce and Real Estate WA are not liable and is released from any claim or demand for damages for any dispute whatsoever and howsoever arising between the user of the site and any service provider listed on the www.findandfix.com.au website either at the time of the listing or at any time before or after.

Neither Commerce, Real Estate WA or any of its employees or agents are liable to any person for any damages, howsoever incurred, arising from information of any kind that FindandFix.com.au supplies or services requested from the site whether the damages are direct, indirect, incidental, special or consequential. Commerce and Real Estate WA do not warrant or guarantee the accuracy of any information that is supplied on the www.findandfix.com.au website including but not limited to contact details for service providers.
6. The user of the www.findandfix.com.au website and information contained therein is at least 18 years of age, is not otherwise prevented from entering into a binding agreement and acknowledges that the use of any information sourced from the www.findandfix.com.au website is at the user's own risk.
